Travelers Insurance hit with underinsured motorist benefits suit, Ferguson Law handling case

BEAUMONT – Travelers Insurance was recently hit with a lawsuit seeking underinsured motorist benefits.

Through The Ferguson Law Firm, Joshua Fleetwood filed the suit against Travelers Insurance in Jefferson County District Court.

According to the lawsuit, on March 27, 2019, Fleetwood was a passenger in a vehicle traveling on Tram Road when an employee for Daryl Thomason Trucking disregarded a red light and smashed into the vehicle he was riding in.

Fleetwood was covered by an insurance policy with Travelers in the amount of $1 million for uninsured/underinsured benefits. On July 7, Fleetwood sent a full policy demand for benefits, which was wrongfully denied, the suit states.

“Although Travelers Insurance received premiums to cover Mr. Fleetwood for UIM/UM benefits, Travelers Insurance has failed to honor its agreement,” the suit states. “Given Travelers Insurance has refused to pay anything to Plaintiff, he is forced to file this bad-faith lawsuit. Defendant Travelers Insurance has wrongfully denied Plaintiff’s claim for Underinsured Motorist benefits pursuant to the policy, even though the policy provided coverage for bodily injuries and damages such as those suffered by Plaintiff as a result of the wreck.”

Fleetwood is seeking more than $1 million in damages.
