Restaurant tenant alleges new building owners locked him out of premises, kept his personal property

HOUSTON — A restaurant operator alleges the new owners of his leased premises locked him out of the building and destroyed his customer relations. 

Rogelip Aguilar filed a complaint Nov. 3 in the Harris County District Court against BF Town Properties LLC, Kit Joseph Shum and Arturo Huerta alleging fraud and other claims. 

According to the plaintiff 's complaint, they entered into a contract for a commercial restaurant lease with Spanish Oaks Center in Spring on April 20, 2015. They allege that in May of 2016, Spanish Oaks sold its premises to the defendants. 

The plaintiff further alleges that the defendants have "conspired to willfully and maliciously" lock him out of the leased premises, deprived him of his possession and enjoyment of his personal property inside the premises and destroyed his business relations with his existing customers. He also alleges the defendants entered into a separate commercial lease agreement with Huerta. Aguilar claims as a result of the defendants' actions, he suffered mental anguish and other damages. 

Aguilar seeks monetary relief between $200,00 and $ 1million, interest and all other just relief. He is represented by Milan Marinkovich and Kyle Moore of Milan G. Markinkovic & Associates PLLC in The Woodlands.
