Houston restaurant faces $1M suit after customer allegedly falls over raised mat

HOUSTON — A Houston restaurant is facing a negligence claim after a customer fell over a raised mat and suffered injuries. 

Luis Espinoza filed a complaint Dec. 16 in Harris County District Court against El Muelle Seafood Corp and Carlos E. Sanchez doing business as El Muelle Seafood alleging negligence. 

Espinoza was at the El Muelle restaurant on Airline Drive in Houston on Jan. 22, 2020. He claims that he tripped and fell over a raised mat that was on the floor and suffered pain, impairment, disfigurement and lost earnings. Espinoza further claims the defendants failed to maintain its premises in a reasonably safe condition, failed to correct the dangerous condition and did not warn of the condition. 

He alleges the defendants also failed to properly inspect their premises, train its employees or implement proper polices and procedures and that they knew or should have known of the risk of harm to customers. He also alleges that as a result of his fall, he incurred medical treatment expenses. 

Espinoza seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Attorney Jonathan Kieschnick in Houston.
