Woman sues Schlotzsky's after tripping over rolled-up poster at Galveston store

GALVESTON — A woman alleges she tripped over a rolled-up decal poster at a store in Galveston and suffered serious injuries. 

America Milligan filed a complaint July 27 in Galveston County District Court against Schlotzsky's Texas Stores LLC alleging negligence. 

Milligan, according to her suit, was at the defendant's store on 61st Street in Galveston on June 16, 2022. She claims as she was entering the store, she slipped and fell over a rolled-up decal poster board and suffered severe injuries. Milligan alleges the defendant was negligent for failing to maintain its floors and walkways in a reasonably safe condition and failed to inspect the area where the dangerous condition existed. 

She also alleges the defendant failed to warn of the hazard or correct the dangerous condition by taking measures to safeguard customers. Milligan claims as a result of the accident, she suffered physical impairment and disfigurement, lost wages and incurred medical expenses. 

Milligan seeks monetary relief of $250,000 or less, interest, trial by jury and all other just relief. She is represented by Jacob Mustafa of The Daspit Law Firm in Houston.
