Injured Port Terminal Railroad worker sues

HOUSTON — A Port Terminal Association Railroad switchman who was injured is claiming negligence. 

Edwardo Reyes filed a complaint Aug. 3 in Harris County District Court against Hfotco LLC and Port Terminal Railroad Association alleging negligence and premises liability. 

According to his complaint, Reyes was working as a switchman for Port Terminal Railroad at Hfotco's facility in Houston on Oct. 1, 2021. He claims that while walking to switch one of the railroad cars, a load bearing cover on track gave way and caused him to fall and suffer injuries to his back and leg. He alleges Port Terminal Railroad's negligence for failing ensure the work area was safe and comply with governing standards and regulations. 

Reyes further alleges Hfotco's negligence for failing to secure the railroad cover, failed to inspect the area ad allowed the dangerous condition to exist. He also alleges Hfotco failed to follow federal regulations, correct the hazard or ensure the area where he would be working complied with safety rules. Reyes claims he suffered physical pain, lost wages, benefits and incurred expenses for medical care as a result of his injuries. 

Reyes seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Clint McGuire of Martinez & McGuire PLLC in Houston.
