Roofer sued over alleged fraud, breach of contract

HOUSTON - A lawsuit filed in Harris County court seeks roughly $40,000 in damages against a Houston-area roofing company, accusing the business of performing shoddy work, misrepresentation and other fraudulent business practices, then dropping the man as a client after he complained.

According to the suit, filed July 31 in Harris County District Court, Ian Bauer of Pasadena, TX hired Pulse Roofing and Restoration LLC of Cypress, TX, after a tornado ripped through his home in January. On the recommendation of a neighbor, the suit read, Bauer hired Pulse to repair his roof and other damage to his home, which required a total demolition of his roof, at a cost of $39,155. The suit further alleged that the project "ultimate fell short of the expected level of workmanship within the industry," the suit read.

Bauer's lawsuit further alleges that Pulse didn't secure the proper permits to perform the work, then gave him a inflated quote based on an insurance estimate. The suit also says that the company did incomplete work on the roof, "neglecting crucial aspects of the project, like the replacement of ridge vents and exhaust fans," adding that not only were those part eliminated, but the company removed the existing ones and covered over them. Moreover, the suit alleges that Pulse applied roofing to rotten wood, "failing to notify Bauer about the existing damage and the need for structural repair," the suit read.


After Bauer complained, the suit continues, a representative from Pulse insulted him, blamed the poor work on an independent contractor Bauer had hired to inspect the work, and offered a $6,327 refund. The company also terminated Bauer as a client due to his use of a third party, and has since made no effort to fix the work.

The suit accuses Pulse of breach of contract, gross negligence, negligent misrepresentation, common law fraud, fraud by nondisclosure, breach of warranty, and violations of the Texas Deceptive Trade Practices Act. In addition to the damages, Bauer's suit also seeks attorney's fees, interest and court costs, the suit stated.
