HOUSTON – A shopper is filing a negligence lawsuit against a Houston H-E-B, claiming she slipped on the floor and injured herself in the store.

Plaintiff Betty Battles filed the lawsuit in the Harris County District Court against H-E-B, LP, citing negligence and premises liability.

According to the lawsuit, Battles was a patron at an H-E-B store in Houston on April 12, 2022. She claims that while she was shopping, she slipped on a liquid that had pooled on the floor due to a leaking refrigerator and fell, sustaining serious injury.

The lawsuit accuses the defendant of several acts of negligence, including failing to properly inspect and maintain the premises to protect the safety of customers, failing to correct a dangerous condition, failing to provide proper warning to customers, including the plaintiff, of the dangerous condition of the premises, and failing to properly train employees.

Battle alleges that she sustained bodily injuries because of the defendant's negligence. She is seeking damages in excess of $250,000 for pain, suffering, mental anguish, physical impairment, disfigurement, loss of earnings and earning capacity, and medical expenses, plus interest, court costs, and any other relief the court deems proper.

The plaintiff is represented by attorneys Jordan A. Glaze, Josh Garrett and Greg Geddie of Glaze | Garrett in Gilmer.
