Woman slips on squashed cherry tomato, sues H-E-B

HOUSTON - A woman claiming she slipped on a squashed cherry tomato has filed suit against H-E-B. 

Seeking up to $250,000 in damages, Madeline Dube filed her suit on Feb. 23 in Harris County District Court. 

According to the lawsuit, on Feb. 28, 2022, Dube was shopping at H-E-B and walking through the organic foods section when she slipped on a squashed cherry tomato, causing her to fall to the ground. 

The suit accuses the store of negligently failing to maintain a safe premises.
