Elvin Montes sues Uptown Construction for negligence leading to serious bodily harm

In the District Court of Harris County, Texas, Elvin Montes has filed a lawsuit against Uptown Construction Services, LLC. The case, with ID 2024-18493 and dated March 22, 2024, alleges negligence on the part of the defendant leading to serious bodily harm to the plaintiff.

Montes was employed by Uptown Construction Services and on November 30, 2023, he fell from a second-story building due to lack of personal protection equipment and unsafe job site conditions. The incident led to immediate medical attention under a fictitious name orchestrated by his supervisor, Ortega, an employee of the defendant company.

The plaintiff accuses Uptown Construction Services of failing to maintain proper procedures for safety at work sites and failing to provide personal protective equipment among other allegations. Montes incurred medical expenses and suffered physical pain and suffering in addition to loss of earnings due to this incident.

Montes is seeking monetary relief over $1,000,000 for damages including past and future medical expenses, past and future physical pain and suffering, loss of earnings in the past and future as well as past and future mental anguish. A jury trial has been demanded by the plaintiff.
