Plaintiffs Allege Negligence Against Comfort Inn & Suites Over Toxic Mold Exposure

Mary Allen and Edith Daves have filed a premises liability and negligence complaint against Southwest Hotels, Inc. doing business as Comfort Inn & Suites SW Houston Sugarland, Choice Hotels International, Inc., and Choice Hotels International Services Corp. The complaint was filed in the District Court of Harris County, Texas on May 14, 2024.

According to the complaint, Allen and Daves allege that during their stay at the Comfort Inn & Suites located at 11050 Southwest Freeway, Houston, Texas, they were exposed to toxic mold due to a leaking ceiling in their room. The plaintiffs claim that despite notifying hotel staff about the leak early in the morning on May 14, 2024, no action was taken until several hours later when a maintenance worker briefly inspected the ceiling without providing any updates or solutions. It wasn't until later that day that they discovered mold in the fallen ceiling tiles.

The plaintiffs argue that the defendants had a duty to operate, manage, maintain, control, and supervise the hotel premises safely and lawfully to prevent personal injuries. They accuse the defendants of failing to inspect and remedy dangerous conditions within Room 112 where they stayed. "The mold in the ceiling constituted an unreasonably dangerous condition which Defendant knew or should have been aware of," states the complaint.

Allen and Daves assert that as a result of this negligence, they suffered physical pain and medical issues including developing a cough during their stay. They seek compensation for past and future physical pain, medical expenses, and physical impairment. The plaintiffs are requesting damages exceeding $250,000 but not more than $1 million.

Presutti P.C., Allen and Daves are demanding judgments against all defendants jointly and severally for adequate damages determined by a jury along with pre-judgment and post-judgment interest as allowed by law.
