Plaintiff accuses dog owner of negligence after severe attack

In a recent court filing, Rian Barrett Reynolds has lodged a negligence complaint against Daniel Maya. The complaint was filed on May 17, 2024, in the District Court of Harris County, Texas.

According to the documents submitted by Reynolds, the incident occurred on January 25, 2024. Reynolds alleges that while delivering a package to Maya's residence at 418 Vashti Drive in Houston, she was suddenly attacked by Maya's dog. The plaintiff claims that the dog jumped over a fence and viciously bit her on both arms. Reynolds asserts that Maya failed to take appropriate measures to control or restrain his aggressive pet, leading to severe bodily injuries.

Reynolds' legal team argues that Maya had a duty to exercise ordinary care as any reasonable person would under similar circumstances. The lawsuit states: "Defendant breached their duty by failing to exercise ordinary care in the restraint and control of his aggressive dog." As a result of this alleged negligence, Reynolds suffered significant damages including medical expenses (both past and future), physical pain and suffering, physical impairment, mental anguish, disfigurement, and loss of earning capacity.

The plaintiff is seeking monetary relief exceeding $200,000 but not more than $1 million. Additionally, Reynolds demands actual damages along with pre-judgment and post-judgment interest. She also requests compensation for court costs and any other relief deemed appropriate by the court.

The case is being handled by attorney R. Keith Weber Jr., from Weber Law Firm based in Houston. The presiding judge for this case is yet to be named under Case ID 2024-31656.
