Man sues AutoZone for negligence leading to personal injury

Masood Poorsaid has filed a negligence complaint against AutoZone, Inc. in the District Court of Harris County, Texas. The complaint was officially lodged on May 13, 2024, by Poorsaid, alleging that AutoZone's negligence led to his personal injuries.

According to the filing, Poorsaid was at an AutoZone store located on Fondren Road in Houston on March 23, 2023. While navigating the oil aisle, he collided with a booklet hanging from a shelf and fell, sustaining serious injuries that required medical attention. The plaintiff asserts that AutoZone failed to maintain safe premises and neglected its duty of care towards customers. Specifically, the complaint accuses AutoZone of failing to monitor and promptly clear the aisle area, improperly training employees, neglecting to warn about dangerous conditions, and creating hazards.

The plaintiff further alleges that these failures were not just acts of simple negligence but constituted gross negligence under Texas law. The filing states: "Defendant’s acts and/or omissions involved an extreme degree of risk considering the probability and magnitude of potential harm to others; and Defendant had actual awareness of the risks involved but proceeded with conscious indifference." Additionally, Poorsaid claims that AutoZone negligently hired, supervised, trained, and retained its employees.

Poorsaid is seeking monetary relief exceeding $1 million for various damages including physical pain and mental anguish both past and future, medical expenses incurred and anticipated future costs, physical impairment and disfigurement suffered as a result of the incident. He also requests pre-judgment interest at the maximum rate allowed by law along with post-judgment interest and court costs.
