Christine Jones has filed a premises liability and negligence complaint against Houston Foods, Inc., Tri City Foods of Illinois LLC, and Dhanani Group of Companies, Inc. The complaint was lodged in Harris County Civil Court at Law No. 4 on May 22, 2024.
According to the filing, Christine Jones, a resident of Harris County, Texas, alleges that she suffered severe injuries due to an unsafe condition at a Burger King restaurant located at 127 E Crosstimbers St., Houston. On February 20, 2024, while ordering breakfast and en route to the restroom, Jones slipped on standing water in the hallway and fell. The fall resulted in debilitating injuries to her shoulders, hips, knees, head, neck, upper back, mid-back, lower back, and body generally.
Jones asserts that as a business patron classified as an invitee under premises liability jurisprudence, she was owed a full duty of reasonable care by the defendants. She claims that Houston Foods Inc., Tri City Foods of Illinois LLC (which regularly conducts business in Texas), and Dhanani Group of Companies Inc. had control over the premises as they owned, operated, managed or maintained the restaurant. Furthermore, Jones contends that the defendants had actual or constructive knowledge of the water on the floor but failed to exercise reasonable care to eliminate this risk.
The plaintiff’s petition states: "Defendants’ failure to use reasonable care in reducing or eliminating the risk of harm caused by the water proximately caused Plaintiff's injuries and monetary damages." Additionally accusing them of negligent activity ongoing at the time of her injury. The allegations include allowing water to exist in a high-traffic area without remedial action despite knowing it was hazardous and failing to ensure a safe environment free from tripping hazards.
Jones is seeking aggregate monetary relief not exceeding $250,000 for past medical expenses; reasonably anticipated future medical expenses; past and future pain and suffering; past physical disfigurement; future physical disfigurement; past mental anguish; future mental anguish; lost wages or loss of earning capacity; diminished future earning capacity; impairment; loss of enjoyment of life among other damages caused by defendants' tortious conduct. She also seeks pre-judgment and post-judgment interest at maximum rates allowed by law.
