Tiffany Brown has filed a personal injury complaint against Houston Aquarium, Inc., doing business as Downtown Aquarium. The lawsuit was filed on May 20, 2024, in Harris County District Court by Brown, who alleges that she sustained serious injuries due to the negligence of the aquarium's staff.
According to the court documents, Tiffany Brown, a resident of Calcasieu Parish, Louisiana, visited the Downtown Aquarium in Houston on June 11, 2022. During her visit, she was struck in the face by a basketball thrown by an employee of the aquarium. The impact broke her glasses and fractured her nose, necessitating immediate medical attention on-site. Brown claims that this incident was a direct result of the aquarium's failure to properly train its employees and maintain a safe environment for visitors.
The plaintiff argues that Houston Aquarium, Inc. is liable under premises liability and negligence laws. She asserts that as an invitee on the property, she was owed a duty of care which the defendant failed to uphold. "Defendant created an unreasonably dangerous condition," states the complaint. It further accuses the aquarium of failing to implement and enforce adequate safety policies and procedures designed to prevent such incidents.
Brown is seeking monetary relief exceeding $250,000 but not more than $1 million for medical expenses incurred both past and future, physical pain and suffering, mental anguish, lost wages, and loss of enjoyment of life among other damages. Additionally, she demands exemplary damages and requests a jury trial.
Representing Tiffany Brown are attorneys Ralph P. Manginello and Lupe Sosa from The Manginello Law Firm PLLC. The case has been assigned Case ID 2024-31784 with Judge Wanda Chambers presiding over it in Harris County District Court.
