Patron sues nail salon for collapsed stool

A patron of a nail salon is suing the establishment for negligence after a fall that resulted in personal injuries. Araceli Camarillo Ramirez filed a complaint against NKD, LLC, doing business as Westfield Nails Salon, in the Harris County District Court on May 30, 2024.

According to the complaint, Ramirez was visiting the Westfield Nails Salon on June 18, 2022, when she suffered an accident. The incident occurred while Ramirez was getting her nails done; another customer attempted to pass by her chair. In an effort to make room, Ramirez adjusted her stool which then collapsed under her weight, causing her to fall to the floor. The lawsuit alleges that this fall and subsequent injuries were directly caused by the negligence of the salon and its employees.

Ramirez claims that the defendant failed in several critical areas of responsibility. The lawsuit outlines specific accusations including: failing to maintain a safe environment free from hazards, not correcting dangerous conditions on their premises, neglecting to warn patrons about these dangers, and failing to properly inspect and maintain their equipment. Additionally, it asserts that Westfield Nails Salon did not adequately train their staff or implement necessary safety policies and procedures.

The plaintiff argues that she has suffered significant physical pain and suffering both in the past and likely into the future due to this incident. She also cites medical expenses incurred as a result of her injuries and anticipates further costs for ongoing treatment. Moreover, Ramirez is seeking compensation for lost earnings and diminished earning capacity as well as damages related to loss of consortium with her family members.

Ramirez's legal team has requested monetary relief exceeding $250,000 but not more than $1 million. They are also pursuing exemplary damages due to what they describe as "conscious indifference" on part of the defendant towards the safety and welfare of its patrons. The petition emphasizes that these damages are warranted given the extreme risk posed by the defendant’s actions or lack thereof.

The case is being handled by Kristin Suniga from Marcos & Associates P.C., representing Araceli Camarillo Ramirez. It has been assigned Case ID 2024-34015 and will be presided over by judges from Harris County's 157th Judicial District Court.
