Houston Shopper Sues Family Dollar for Negligence After Store Accident

A Houston resident has filed a lawsuit against a major retail chain, alleging serious injuries sustained due to the store's negligence. On May 29, 2024, Kurt Green filed a complaint in Harris County Civil Court at Law No. 2 against Family Dollar Stores of Texas, LLC.

According to the court documents, the incident occurred on September 26, 2023, when Green was shopping at the Family Dollar store located at 2128 Spears Rd #700 in Houston. While inside the store intending to purchase items, Green claims that stacked shelves laden with merchandise collapsed onto him. The falling shelves struck his leg and caused him to fall sharply onto his knee and then heavily onto the ground. As a result of this fall, Green alleges he sustained serious bodily injuries.

Green's petition accuses Family Dollar Stores of premises liability and negligence. He asserts that the store negligently allowed dangerous conditions to exist by failing to secure heavy merchandise properly. Specifically, he claims that Family Dollar failed to keep hazardous equipment in a reasonably safe condition and did not take necessary measures to safeguard invitees from potential harm. "Defendant is liable under the theory of premises liability and gross negligence," reads part of the filing.

Green's legal team argues that Family Dollar should have recognized and corrected these hazards as they posed an extreme degree of risk to customers. They allege that despite knowing about these risks or having reason to know about them, Family Dollar did not provide adequate warnings or take steps to make the premises safe for shoppers like Green.

The plaintiff is seeking monetary relief for various damages resulting from his injuries. These include physical pain and mental anguish both past and future, loss of earning capacity, lost wages and earnings, disfigurement, medical expenses incurred due to the injury, and punitive damages within the jurisdictional limits of the court. The maximum amount sought by Green does not exceed $200,000.

Additionally, Green has requested that all evidence related to the incident be preserved by Family Dollar Stores. This includes any statements, photographs, videotapes, surveillance footage, business records or any other relevant documentation that could support his claims in court.
