Former Employee Sues Fila-Mar Energy Services for Negligence Leading to Severe Injuries

A Texas man has filed a lawsuit against his former employer, alleging negligence that led to severe injuries. Eric Rivera lodged the complaint in Harris County District Court on June 3, 2024, targeting Fila-Mar Energy Services, LLC.

According to the court documents, Rivera claims he was instructed by his supervisor at Fila-Mar Energy Services to install a GPS device on his tractor-trailer without proper training or instructions. This incident occurred on October 4, 2023, at a trailer yard owned and operated by Fila-Mar. Rivera alleges that while attempting to install the device as directed, he fell from the highest step of his truck and sustained severe injuries. "Defendant owed a duty to Plaintiff to exercise ordinary care," reads the petition, highlighting that the company failed in several aspects including proper training and supervision of its employees.

Rivera's petition outlines multiple accusations against Fila-Mar Energy Services. He asserts that the company was negligent in various ways: failing to train and monitor employees properly regarding GPS installation, failing to supervise activities adequately, and instructing him to install the GPS device without providing necessary guidance or supervision. The document states that these actions collectively constituted negligence and were the proximate cause of Rivera's injuries.

The plaintiff is seeking damages exceeding $1 million for physical pain and mental anguish, physical impairment, disfigurement, lost earnings, loss of earning capacity, and medical expenses. Additionally, Rivera is requesting pre-judgment and post-judgment interest at the maximum legal rate. The complaint also notes that all conditions precedent to Rivera’s right to recover have been performed or have occurred.

Representing Eric Rivera are attorneys Francis Guerra IV, Jennifer A. Neal, and Omar Quiroz from Guerra LLP based in San Antonio. The case has been assigned Case ID 2024-34821 and will be heard in Harris County's 125th Judicial District Court with Judge Cynthia Clausell-McGowan presiding.
