Tenant Accuses Houston Apartment Complex of Negligence Leading to Health Issues

A tenant in Houston is suing her apartment complex and its property management company for negligence, claiming that exposure to toxic mold in her apartment caused severe health issues, including a miscarriage. Romesha Brooks filed the complaint on May 30, 2024, in the Harris County District Court against Broadstone Energy Park, LLC, and several associated entities.

Brooks alleges that during her tenancy at Broadstone Energy Park, located at 880 S Highway 6 South, Apartment 1079, she was exposed to dangerous levels of mold due to the defendants' failure to maintain the property adequately. The lawsuit details how Brooks experienced recurring water leaks and flooding in her apartment starting from two months after she moved in on May 31, 2022. Despite multiple complaints and temporary fixes by maintenance staff, the underlying issues were never resolved. This neglect led to significant water damage and subsequent mold growth.

An independent inspection revealed elevated levels of Aspergillus/Penicillium and Cladosporium molds in Brooks' living space. These findings corroborated Brooks' claims of experiencing various health problems such as skin rashes, cold and flu-like symptoms, muscle pains, chronic fatigue, and ultimately a miscarriage. "The Apartment Complex Owner and Property Management failed to properly remediate the property even after being notified of the hazardous conditions," Brooks stated in her filing.

Brooks seeks over $1 million in damages for medical expenses, loss of earning capacity, mental anguish, and other related costs. She is also asking for punitive damages due to what she describes as gross negligence by both the apartment complex owner and property management company. The plaintiff argues that these entities had a duty to ensure a safe living environment but failed repeatedly despite being aware of the risks posed by mold exposure.

The case has been assigned to Judge Taiasha Bradford in the 164th Judicial District Court under Case ID: 2024-341T. Representing Brooks is attorney Kristina S. Bae from Just Well Law PLLC.
