Plaintiff Alleges Negligence by Seafood Company Following Workplace Injury

A serious workplace injury has led to a significant legal battle in Harris County, Texas. On June 18, 2024, Jonathan Ruth filed a complaint against Wills Fresh Seafood, LLC in the District Court of Harris County, seeking damages for injuries sustained while working at the defendant's food truck.

According to the complaint, Ruth was injured on April 27, 2024, while unloading seafood at Wills Fresh Seafood's food truck located near the intersection of Uvalde Road and Wallisville Road in Harris County. The plaintiff alleges that his injuries were due to the negligence of Wills Fresh Seafood and its employees. Specifically, Ruth claims that the company failed to provide a safe working environment and did not properly supervise or train their staff. "Defendant was negligent and/or negligent per se for one or more of the following reasons," states the petition, listing failures such as inadequate supervision of subcontractors and employees, neglecting work-related hazards, and violating local, state, and federal laws.

Ruth's lawsuit highlights multiple areas where he believes Wills Fresh Seafood fell short in their duty of care. These include failing to ensure safe operations of machinery and vehicles, negligent hiring practices, and conducting unsafe active operations on their premises. The plaintiff asserts that these lapses directly led to his severe injuries which have resulted in extensive medical expenses and significant physical pain and suffering.

The plaintiff is seeking monetary relief between $250,000.00 and $1,000,000.00 for various damages including past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, as well as lost wages and diminished earning capacity. Additionally, Ruth is requesting pre-judgment and post-judgment interest along with all court costs.
