Texas Resident Sues Multiple Companies Over Negligence Leading to Severe Injuries

A Texas resident has filed a lawsuit against multiple companies, alleging severe injuries due to negligence at a Seabrook restaurant's parking lot. Megan Wilkerson lodged the complaint on June 26, 2024, in Harris County District Court against Bay Area Restaurants, Inc., Morgan Land, LLC, and Lakeside Yachting Center, Inc.

The case stems from an incident on July 15, 2023, when Wilkerson fell in the parking lot of Classic Café located at 2511 E Nasa Rd. in Seabrook. The plaintiff asserts that the parking area was unlevel, uneven, cracked, and poorly lit. According to the petition, these hazardous conditions were known to the defendants but were not addressed or adequately signposted to warn patrons. "Defendants negligently created an extreme danger," the complaint states. As a result of her fall, Wilkerson suffered injuries to her face, teeth, knees, legs, and other parts of her body.

Wilkerson's lawsuit claims that Bay Area Restaurants Inc., Morgan Land LLC., and Lakeside Yachting Center Inc. failed in their duty of care by not maintaining a safe environment for visitors. The plaintiff accuses the defendants of multiple counts of negligence including failing to provide a safe parking lot, failing to ensure the area was even and level, neglecting to block off dangerous areas or warn about them adequately. The complaint highlights that these failures constitute breaches of non-delegable legal duties owed by the defendants.

In terms of relief sought from the court, Wilkerson is demanding monetary compensation exceeding $1 million for past and future medical expenses, physical pain and mental anguish, physical impairment and disfigurement as well as lost wage-earning capacity. Additionally, she seeks punitive damages due to what she describes as knowing and malicious actions by the defendants. Pre-judgment and post-judgment interest are also requested.

Representing Megan Wilkerson is Sean E. O'Rourke from Simon & O’Rourke Law Firm PC based in Houston. The case has been assigned Case ID 2024-40603 and will be heard in Harris County’s 129th Judicial District Court with Judge Marilyn Burgess presiding.
