Texas Resident Sues Local Bar Over Serious Injuries Caused by Uneven Grates

A Texas resident has filed a lawsuit against a local bar, alleging negligence and premises liability after suffering serious injuries on the establishment's property. The complaint was filed by Russell Rudolph in the Harris County District Court on July 3, 2024, naming Golden Partnerships Inc., doing business as The Standard Bar HTX, as the defendant.

According to the court documents, Rudolph claims that he sustained significant injuries due to uneven grates on the property of The Standard Bar HTX located in Houston. The incident occurred in October 2023 when Rudolph was an invitee at the bar. He alleges that he tripped over these grates, resulting in severe bodily harm. "Plaintiff did not have any knowledge of the dangerous condition and could not have reasonably been expected to discover it," states the petition. Rudolph contends that Golden Partnerships Inc. either created this hazardous condition or failed to rectify it or warn patrons about it, thereby constituting negligence.

The plaintiff's claims are based on two primary legal theories: premises liability and negligence. Under premises liability, Rudolph asserts that Golden Partnerships Inc. failed to warn him about the uneven grates and did not take adequate measures to cordon off the area. He further argues that these failures were direct causes of his injuries. In terms of negligence, Rudolph accuses the bar's employees and agents of neglecting their duty to maintain a safe environment for patrons. Specifically, he alleges that they had actual knowledge of the danger posed by the uneven grates or should have known through ordinary care.

Rudolph is seeking monetary relief exceeding $1,000,000 for various damages including past and future medical expenses, physical pain and suffering, loss of earnings and earning capacity, loss of household services, and mental anguish. "As a direct and proximate result of the occurrence made the basis of this lawsuit," reads the petition, "Plaintiff has sustained serious bodily injuries."

The case is being handled by attorney James D. Burkhalter from Smith & Hassler law firm. It has been assigned Case ID 2024-42477 in Harris County District Court with Judge Adiliani Solis presiding.
