Frank Rivera Accuses Hotel Operator HSR Ghuman LLC of Negligence Leading to Injury

Frank Rivera has filed a lawsuit against HSR Ghuman, LLC, seeking over $1 million in damages for injuries sustained at one of the company's properties. The complaint was filed on November 6, 2024, in the District Court of Harris County, Texas. Rivera alleges that the negligence of HSR Ghuman led to his injuries.

The incident occurred on April 14, 2024, when Frank Rivera visited La Quinta Inn & Suites located at 110 BMT Drive in Jourdanton, Texas. As he walked across the parking lot median towards the hotel entrance, he tripped over a bent T-post that was obscured by overgrown grass and not visible to pedestrians. This fall resulted in significant injuries for Rivera. He claims that the dangerous condition of the premises directly caused his injuries and accuses HSR Ghuman of failing to ensure guest safety by neglecting necessary precautions.

Rivera's lawsuit is grounded in premises liability law. He argues that as an invitee on the property owned and operated by HSR Ghuman, LLC, he was owed a duty of care to be provided with a reasonably safe environment. The plaintiff contends that HSR Ghuman had control over the premises and thus had certain non-delegable duties which they breached. These breaches included failing to maintain a safe parking lot median and not warning guests about potential hazards like the obscured T-post.

The complaint further accuses HSR Ghuman of gross negligence under Texas Civil Practice & Remedies Code Section 41.001(11)(A)-(B). It states that their conduct involved an extreme degree of risk and demonstrated conscious indifference to guest safety despite being aware of the potential dangers posed by such conditions on their property.

Rivera seeks unliquidated damages within the court's jurisdictional limits for past and future physical pain and suffering, mental anguish, physical impairment, disfigurement, and medical expenses incurred due to his injuries. Additionally, he requests pre-judgment and post-judgment interest as allowed by law.
