Shopper Sues Retail Giant Over Negligence Leading to Severe Injuries

A woman has filed a lawsuit against a major retail corporation, alleging severe injuries due to negligence. Eva Garza lodged the complaint in Harris County Civil Court on July 16, 2024, targeting Walmart for what she claims was an unsafe condition in one of its stores.

According to the court documents, Garza was shopping at a Walmart store on August 22, 2022, when she slipped and fell on a dangerously wet floor that lacked any safety warnings. She contends that Walmart failed to maintain the premises safely and did not adequately train or supervise its employees to handle such hazards. The plaintiff's petition states, "Defendant exposed its unsuspecting customers and Plaintiff to an unreasonably dangerous condition," further accusing Walmart of gross negligence under Texas law.

Garza's complaint details multiple instances of alleged negligence by Walmart. These include failing to inspect walking areas for hazards, not putting up barriers around dangerous conditions, and neglecting to warn customers about potential risks. The lawsuit asserts that these failures led directly to Garza's injuries, which are described as permanent and debilitating. "Defendant knew or should have known of the dangerous condition on its premises," the document reads, emphasizing that Walmart had ample opportunity to rectify the situation but did not.

The plaintiff is seeking various forms of relief from the court. These include compensation for physical pain, mental anguish, physical impairment, lost wages or loss of earning capacity, medical care and treatment costs, and exemplary damages aimed at punishing Walmart for gross negligence. Additionally, Garza has requested that all evidence related to the incident be preserved by Walmart to prevent spoliation.
