A woman has filed a lawsuit against a prominent Houston-based cosmetic surgeon and his affiliated entities, alleging gross negligence that led to severe medical complications. The complaint was lodged by Sonia Rubio Munoz in the Harris County District Court on July 19, 2024, targeting Dr. Marcos Ikeda and several of his business ventures.
According to the court documents, Sonia Rubio Munoz underwent a breast augmentation procedure at Houston Galleria Surgery & Medspa, which is operated by Dr. Marcos Ikeda and his associated entities. The surgery was performed by Dr. Ikeda himself but resulted in severe complications that required multiple corrective procedures. "The treatment of Rubio Munoz fell below the accepted standards of medical care and was the proximate cause of her injuries," the filing states.
Munoz noticed that her right breast implant was improperly placed a few months after the initial surgery. Despite undergoing an additional corrective procedure by Dr. Ikeda, she began experiencing swelling, pain, and discomfort in her left breast shortly thereafter. The plaintiff claims that Dr. Ikeda's office initially prescribed antibiotics without examining her condition properly. When her symptoms worsened, including pus discharge from the surgical site, Munoz sought emergency medical attention at Lyndon B. Johnson Hospital where both implants were removed due to infection and necrosis.
The lawsuit alleges that Dr. Ikeda and his businesses breached their duty of care by failing to provide appropriate follow-up care and allowing unlicensed foreign medical graduates to present themselves as physicians to patients like Munoz. Furthermore, it accuses them of corporate negligence for not maintaining adequate staffing levels or proper training for their employees.
Munoz is seeking monetary relief exceeding $1 million for medical expenses incurred in the past and future, loss of earnings capacity, pain and suffering, mental anguish, loss of consortium, physical impairment, inconvenience, and loss of enjoyment of life. She also seeks exemplary damages for what she describes as gross negligence on the part of Dr. Ikeda and his associated entities.
The case has been assigned Case ID 2024-45438 in the 164th District Court of Harris County with Judge Marilyn Burgess presiding over it. Attorneys Melissa Moore and Curt Hesse from Moore & Associates are representing Sonia Rubio Munoz in this matter.
