Texas Woman Sues Doctor Over Alleged Medical Negligence Resulting in Lifelong Disability

A Texas woman has filed a lawsuit alleging severe medical negligence that has left her with lifelong disabilities. On July 19, 2024, Necole Foreman filed a complaint in the Harris County District Court against Dr. Sybil J. Fisher, DPM.

According to the court documents, Foreman, a 53-year-old resident of Texas, sought medical treatment from Dr. Fisher for bilateral hallux valgus and underwent multiple surgical procedures on November 30, 2022. These included a left tarsometatarsal fusion, McBride bunionectomy, and arthroplasty on her fourth and fifth toes. Post-surgery, Foreman experienced increased foot pain and difficulty walking but was reassured by Dr. Fisher that these symptoms were part of the healing process.

However, in June 2023, an MRI revealed that Foreman's tibial tendon had been transected during surgery. Seeking a second opinion confirmed this diagnosis, leading to another corrective procedure in September 2023 to reconnect the tendon to the bone. Despite this intervention, Foreman has developed irreversible drop foot and will require assistance to walk for the rest of her life.

Foreman's lawsuit accuses Dr. Fisher of failing to adhere to accepted standards of medical care and practicing negligence by not properly managing conservative treatments before opting for surgery. The complaint states that "SYBIL J. FISHER failed to appropriately identify and protect the tibial tendon resulting in it being transected," thereby breaching the standard of care expected from a medical professional.

The plaintiff is seeking monetary relief exceeding $1 million for physical pain and mental anguish both past and future; physical impairment; disfigurement; loss of earning capacity; loss of services; and reasonable and necessary medical expenses incurred as a result of the alleged negligence.

The case is represented by attorneys Gabe Sassin and Tommy R. Hastings from Hastings Firm P.C., while it will be presided over by Judge Gerardo Perez in the 234th Judicial District Court under Case ID: 2024-45252.
