A Houston woman has filed a lawsuit against a local aesthetic center and its employee, alleging severe medical negligence that resulted in significant physical and emotional suffering. Maria Betania Anez Daza initiated the complaint on July 23, 2024, in Harris County District Court against Alexander Padilla and the Houston Aesthetic Center.
According to the court documents, Daza visited the Houston Aesthetic Center for a consultation regarding liposuction surgery. On April 19, 2023, she underwent the procedure performed by Padilla. Following the surgery, Padilla allegedly canceled her follow-up appointment without providing any reason. This lack of post-operative care led to immense pain for Daza. It wasn't until July 23, 2023, that she finally received a follow-up appointment where it was determined that she required repair surgery. During this subsequent procedure in July 2023, Daza reportedly awoke mid-surgery screaming in pain due to what she claims was Padilla's failure to coordinate anesthesia properly.
Daza asserts that Padilla was an employee of the Houston Aesthetic Center and acting within his employment scope during these events. She contends that both defendants were negligent in their duty of care, resulting in her suffering past and future damages including medical expenses, lost wages, pain and suffering, mental anguish, physical disfigurement, and impairment.
The lawsuit brings claims under Chapter 74 of the Texas Civil Practice & Remedies Code (T.C.P.C.), Chapter 41 of the Texas Civil Practice & Remedies Code (T.C.P.R.), and Texas common law. The plaintiff argues that Padilla failed to exercise ordinary care expected from a healthcare provider by not providing adequate medical treatment and failing to do what a prudent health care provider would have done under similar circumstances.
Daza is seeking unliquidated damages within the jurisdictional limits of the court. Specifically, she requests compensation for physical pain, mental anguish, disfigurement, physical impairments, medical expenses both past and future, loss of income and earning capacity, loss of consortium and household services, property damage as well as pre-judgment and post-judgment interest. Additionally, she seeks exemplary or punitive damages to the extent allowed by law along with attorney fees and court costs.
