Texas Resident Sues Major Corporation Over Severe Injury at Store

A Texas resident has taken legal action against a major corporation following a severe injury at one of its store locations. On August 1, 2024, Kim Lopez filed a complaint in the District Court of Harris County, Texas, against Air Liquide USA, LLC doing business as Airgas.

The incident that led to this lawsuit occurred on April 2, 2024. According to the complaint, Lopez was visiting an Airgas store located at 4122 US-80 in Terrell, Texas when she slipped and fell on a sedimentary liquid present on the floor. This fall resulted in severe personal injuries for Lopez. The plaintiff argues that as an invitee legally present on the premises, she was owed a duty of care by the defendant to ensure the premises were safe.

Lopez's petition details her claims under premises liability and general negligence. She asserts that Airgas, as the owner or occupier of the property, had actual or constructive knowledge of the hazardous condition but failed to take necessary actions to repair or warn about it. "Defendant breached its duty to Plaintiff by failing to repair or remedy the condition," states Lopez in her filing. This breach allegedly led directly to her injuries and subsequent damages.

The plaintiff is seeking over $1,000,000 in monetary relief for various damages incurred due to the incident. These include past and future medical expenses, pain and suffering, physical impairment, mental anguish, loss of enjoyment of life and social activities, disfigurement, and loss of earning capacity. Additionally, Lopez is requesting pre-judgment interest at the highest rate allowed by law and post-judgment interest from the date of judgment until collected.

Representing Kim Lopez is attorney Andrew Leibowitz from Leibowitz Law Group P.L.L.C., based in Plano, Texas. The case has been assigned Case ID 2024-48753 and will be presided over by Judge Bernitta Barrett in Harris County's 61st Judicial District Court.
