Former Employee Sues HVAC Company Over Workplace Injury

A former employee has filed a lawsuit against his previous employer and associated entities, alleging negligence and unsafe working conditions that led to severe injuries. Robert Martin filed the complaint in Harris County District Court on August 9, 2024, naming Timothy McKee, McKee Air Conditioning & Heating LLC, and Storage2855 LLC as defendants.

The case revolves around an incident that occurred on October 1, 2022. Martin was employed by McKee Air Conditioning & Heating under the supervision of its president, Timothy McKee. On that day, Martin was instructed to install light fixtures in a storage unit rented by Storage2855 LLC. While performing this task, he fell from a 14-foot-tall step ladder provided by his employer. According to the complaint, "Defendants’ negligence was the proximate cause of the severe injuries which he continues to suffer from to this very day." The plaintiff alleges that the defendants failed to provide proper equipment and a safe work environment.

Martin's lawsuit accuses McKee Air Conditioning & Heating of being a "non-subscriber" that did not offer Workers' Compensation coverage at the time of the incident. This non-compliance with standard safety regulations is cited as one of the primary reasons for seeking relief under Texas law. Furthermore, Martin asserts that Storage2855 LLC had either actual or constructive knowledge of the dangerous condition on their premises but failed to warn him or make it reasonably safe.

The plaintiff is seeking various forms of relief including compensation for medical expenses (both past and future), physical pain and suffering, lost wages, loss of earning capacity, mental anguish, and physical disfigurement. The complaint specifies that these damages fall within the monetary amounts outlined in Rule 47(c)(4) of the Texas Rules of Civil Procedure.
