Customer Sues Liquor Store Owner Over Negligence Leading to Injury

A recent court filing reveals a personal injury lawsuit that could have significant implications for business premises liability. On August 14, 2024, Melanie Bryant filed a complaint in the Harris County District Court against Z&C TXPLUS Corporation.

The lawsuit centers around an incident that occurred on October 21, 2023, at Jim’s Liquor Store located at 7520 W. Belfort Ave., Houston, Texas. According to the complaint, Bryant was an invitee on the premises when she suffered injuries due to what she describes as an "unreasonably dangerous condition." Specifically, her foot got caught on the corner of what appeared to be a box, causing her to fall and sustain bodily injuries. The plaintiff alleges that Z&C TXPLUS Corporation knew about this hazardous condition but failed to correct it or warn customers like herself.

Bryant's petition accuses Z&C TXPLUS Corporation of negligence under Texas law. She asserts that the corporation's failure to address or signal the danger directly resulted in her injuries. "Plaintiff did not have any knowledge of the dangerous condition," states the complaint, adding that her conduct was reasonable and prudent at all times. As such, Bryant argues that she bears no responsibility for the incident and its resulting injuries.

In terms of damages, Bryant is seeking monetary relief of less than $250,000. She claims compensation for past and future medical expenses, physical pain and mental anguish, as well as physical impairment resulting from the accident. Additionally, she has requested disclosures from Z&C TXPLUS Corporation under Rule 194 of the Texas Rules of Civil Procedure within fifty days of service.
