Community Association Sues Property Owners Over Unpaid Assessments

Kingwood Glen Village Community Association has taken legal action against two property owners, alleging unpaid assessments and related charges. The lawsuit was filed by the Kingwood Glen Village Community Association in the Judicial District Court of Harris County on May 2, 2025, targeting Thomas G. Daniel and Mary K. Daniel as defendants.

The case revolves around a property located at 5807 Forest Timbers Drive in Humble, Texas, owned by the Daniels. According to the plaintiff, this property is part of a community governed by a Declaration of Covenants, Conditions, and Restrictions that mandates property owners to pay assessments to the association. The association claims that these payments are essential for maintaining community standards and operations. The Daniels allegedly failed to fulfill their financial obligations under this declaration, resulting in an outstanding balance of $3,138.97 plus additional fees and interest.

The Kingwood Glen Village Community Association asserts that it has repeatedly notified the Daniels about their delinquency but received no payment or response. As per the association's claim, "Plaintiff gave Defendants multiple notices of the delinquency and informed Defendants that failure to pay certain delinquent charges would result in Plaintiff taking necessary steps to foreclose upon its lien." The association is seeking a judgment from the court for all sums due and requests foreclosure on the lien against the Daniels' property if necessary.

In addition to recovering unpaid assessments, the plaintiff seeks reimbursement for attorney fees and costs incurred while pursuing this legal action. They argue that these expenses are justified under both the Declaration governing their community and Texas law. The association's legal team includes attorneys Allison Lollis, David K. The case is being heard in Harris County's 234th Judicial District Court under Case ID 2025-31022 with Judge Wanda Chambers presiding over proceedings.
