In a dramatic legal confrontation, a Harris County resident has filed a lawsuit against a local auto parts store following an incident that allegedly left him with severe injuries. The complaint was lodged by Jose D. Nataren Sarmiento on May 2, 2025, in the District Court of Harris County, Texas, targeting HSHE LLC doing business as Ortiz Auto Parts #2.

The lawsuit arises from an incident that occurred on October 15, 2024, when Sarmiento was visiting the premises of Ortiz Auto Parts #2 located at 5643 N. Shepherd Drive in Houston. During his visit, while shopping for an auto part, an airbag unexpectedly deployed and struck him in the chest. Sarmiento claims this event resulted from "an unreasonably dangerous condition" on the property which the defendant allegedly knew about but failed to rectify or warn him about. The plaintiff asserts that he had no prior knowledge of this hazardous condition and argues that the negligence of HSHE LLC was the proximate cause of his injuries.

Sarmiento describes his injuries as severe, leading to physical impairment and ongoing pain and suffering. He anticipates continued medical expenses due to the nature and severity of his injuries. The complaint highlights that during his visit to Ortiz Auto Parts #2, Sarmiento acted reasonably and prudently at all times and did not contribute to the incident.

The plaintiff is seeking monetary relief amounting to less than $250,000 as per Rule 47 C (3) of the Texas Rules of Civil Procedure. In addition to compensatory damages for his physical injuries and mental anguish, Sarmiento requests pre-judgment and post-judgment interest at the highest legal rate available under law. Furthermore, he demands disclosure from HSHE LLC under Texas Code Rule 194 within fifty days of service.
