A Houston resident has filed a lawsuit against multiple companies, alleging negligence after sustaining injuries from a slip and fall incident. On September 3, 2024, Jose Noe Cruz Iglesias filed the complaint in the District Court of Harris County, Texas, naming I-45 Shell Truck Stop, LLC; Niazi Family Investment, LTD; King Fuels, Inc.; Shell Retail and Convenience Operations, LLC; and Shell Oil Products Company, LLC as defendants.
According to the complaint, Iglesias claims that on October 13, 2022, he slipped and fell on water while on his way to the restroom at a Shell station located at 17141 East Freeway in Channelview, Texas. The plaintiff alleges that the defendants were aware or should have been aware of the dangerous condition but failed to take any action to remedy it. "As a result of the incident and Defendants’ breach," Iglesias asserts that he sustained serious personal injury.
The plaintiff accuses the defendants of negligence and gross negligence for failing to provide a safe environment for their customers. He argues that this failure directly led to his injuries. "The incident was proximately caused by the Defendants' negligence," states Iglesias in his filing. He further contends that the defendants had a duty to ensure customer safety but neglected this responsibility.
Iglesias is seeking various forms of relief from the court. These include compensation for physical pain and mental anguish experienced both in the past and anticipated in the future. Additionally, he seeks damages for lost wages and loss of earning capacity moving forward. Other claims include compensation for physical disfigurement and impairment as well as medical care costs incurred due to the incident. Notably, Iglesias is also asking for exemplary damages and all other damages allowed by law and equity. The total monetary relief sought ranges between $250,000 and $1 million.
