Houston Resident Sues Property Management Company Over Negligence Leading to Severe Injuries

A Houston resident has filed a lawsuit against a property management company and its affiliate, alleging negligence that led to severe personal injuries. Jose Arnoldo Hernandez Ceren lodged the complaint in the District Court of Harris County, Texas, on September 5, 2024, targeting Madison Park Borrower, LLC d/b/a Madison Park Apartments and Tarantino Properties, Inc.

According to the court documents, the incident in question occurred on February 6, 2023. On that day, Hernandez Ceren was injured when a patio collapsed at the Madison Park Apartments located at 9801 Meadowglen Lane in Houston. The plaintiff claims that both defendants were aware or should have been aware of the dangerous condition but failed to take any corrective action. This alleged negligence resulted in serious personal injuries for Hernandez Ceren.

The plaintiff's petition outlines various damages sought due to the incident. These include physical pain and mental anguish both past and future, lost wages and loss of earning capacity in the future, physical disfigurement and impairment both past and future, medical care costs both past and future, exemplary damages, and other allowable damages under law or equity. Hernandez Ceren is seeking monetary relief exceeding $250,000 but not more than $1 million.

Hernandez Ceren argues that the defendants had a duty to provide a safe environment for their tenants and visitors but failed to do so. The complaint states: "The incident was proximately caused by the negligence and gross negligence of Defendants." It further alleges that this failure directly led to his injuries.

In addition to compensatory damages for his injuries and losses, Hernandez Ceren is also seeking pre-judgment interest at the maximum legal rate as well as post-judgment interest as provided by law. He is asking for all costs of suit along with attorney's fees.

Representing Jose Arnoldo Hernandez Ceren is Kraig L. Rushing from his law office located at 2030 North Loop West Suite 260 in Houston. The case has been assigned Case ID 2024-59490 in the 165th Judicial District Court with Judge Marilyn Burgess presiding over it.
