Customer Alleges Negligence Against Mister Car Wash Following Malfunction Incident

Linda Lee, a resident of Harris County, Texas, has filed a lawsuit against CWP Asset Corp, doing business as Mister Car Wash, following an incident that occurred on August 24, 2024. The complaint was filed in the District Court of Harris County on September 27, 2024. Lee alleges that she sustained personal injuries due to a malfunction at Mister Car Wash's Houston location.

According to the details outlined in the petition, Linda Lee was using the car wash services at Mister Car Wash when a malfunction caused her vehicle to be struck from behind by another car. This collision propelled her vehicle forward into another car ahead of her. Lee claims that this incident resulted in significant personal injuries and damages exceeding the jurisdictional limits of the court. She asserts that she followed all instructions provided by the defendant’s employees and did not contribute to the accident.

The plaintiff is pursuing legal action based on premises liability. She argues that Mister Car Wash failed to maintain its equipment properly, creating an unsafe environment for customers like herself. "The condition of the premises, specifically the malfunctioning car wash equipment, posed an unreasonable risk of harm," states Lee in her petition. She further accuses CWP Asset Corp of negligence for not exercising reasonable care in maintaining their premises and ensuring customer safety.

Lee seeks compensation for various damages resulting from this incident. These include past and future medical expenses, pain and suffering, mental anguish, and lost wages or income both past and future. The total monetary relief sought is less than $250,000 but does not exceed $74,999.99 excluding interest and other costs.

In addition to seeking damages for her injuries, Linda Lee requests pre-judgment interest at the maximum rate allowed by law from thirty days after payment was due until judgment is rendered. Post-judgment interest is also sought until full payment is made. Furthermore, she asks for reimbursement of all court costs incurred during this legal process.
