Plaintiff Nail Technician Alleges Local Salon Negligence After Slip-and-Fall Incident

A nail technician's slip and fall incident at a local salon has led to a significant legal battle, with claims of negligence and unsafe conditions taking center stage. On October 3, 2024, Mai Phan filed a lawsuit in the District Court of Harris County, Texas against Phu Uyen Hoang Nails, Inc., operating as AMC Nails. The complaint accuses the defendant of failing to maintain safe premises, resulting in serious injuries to the plaintiff.

The case stems from an incident on December 3, 2023, when Mai Phan was working at AMC Nails located at 5579 Fairmont Parkway in Pasadena, Texas. According to the lawsuit, while performing her duties as a nail technician, Phan slipped on an unseen powdered substance on the floor. The complaint alleges that the salon's management knew or should have known about this hazardous condition but failed to take corrective action or provide any warning to Phan. As a result of this negligence, Phan suffered severe bodily injuries including a broken leg.

Phan's legal team argues that she was an invitee on the premises and thus entitled to a duty of care from AMC Nails. The lawsuit outlines several breaches of this duty by the defendant, including failure to inspect for dangerous conditions, remove hazards like the powdered substance on which Phan slipped, and implement safety protocols for maintaining clean and safe premises. "Defendant’s negligence was therefore a direct and proximate cause of Plaintiff’s injury," states the petition.

The plaintiff is seeking monetary relief exceeding $1 million for damages incurred due to her injuries. This includes compensation for past and future lost wages, medical expenses, pain and suffering, mental anguish, impairment, disfigurement, attorney’s fees and expenses as well as punitive damages aimed at penalizing gross negligence.

Representing Mai Phan are attorneys Niles Sneed, Brit Mitchell, and Emily Faber Vechan from Sneed|Mitchell LLP based in Houston. The case is being heard under Case ID 2024-68247 by Judge Christopher Matthews in Harris County's 152nd District Court.
