Property Manager Accused of Negligence After Visitor's Fall at Shopping Center

Nora Glendy Gomez has filed a lawsuit against BK PlazAmericas, Ltd. and Baker Katz Management, LLC, alleging negligence that resulted in serious injuries from a fall on their property. The complaint was lodged on October 25, 2024, in the District Court of Harris County, Texas. The plaintiff accuses the defendants of failing to maintain safe premises at the Sharpstown Center in Houston.

According to the petition, Nora Glendy Gomez visited the premises owned by BK PlazAmericas and managed by Baker Katz Management on January 10, 2023. As an invitee, she expected a safe environment but instead encountered uneven and cracked concrete that led to her tripping and sustaining significant injuries. The lawsuit claims that the defendants neglected their duty to inspect and rectify hazardous conditions or warn visitors about potential dangers. "Defendants failed to inspect the property and ensure the safety of the hazard which led to Plaintiff's fall," states the petition.

Gomez argues that both companies had control over the property and were responsible for ensuring its safety. She asserts that they either negligently or willfully allowed dangerous conditions to persist without adequate warnings. The lawsuit further alleges that these conditions were known or should have been known by the defendants due to their prolonged existence. As a result of this oversight, Gomez suffered serious bodily harm.

The plaintiff is seeking damages ranging from $250,000 to $1 million for medical expenses, lost wages, physical pain, mental anguish, impairment, and disfigurement caused by her injuries. Additionally, she requests interest on any judgment awarded from the date of injury and coverage for court costs.
