Shirley Castro has filed a lawsuit against a group of businesses, alleging negligence that led to her suffering injuries on their premises. The complaint was lodged in the District Court of Harris County, Texas, on October 22, 2024, targeting Vida Mariscos II, Inc., Cabrera Brothers II, LP, and Los Cucos Mexican Cafe VIII, Inc.
According to the petition filed by Shirley Castro, the incident occurred on April 15, 2023. On that day, Castro was visiting a Vida Mariscos restaurant located at 22400 State Highway 249 in Houston when she slipped and fell due to a slippery substance on the floor. The plaintiff asserts that there were no warning signs posted about the hazardous condition. She accuses the defendants of failing to maintain safe premises and neglecting their duty to warn patrons of potential dangers. "Defendants’ failure to inspect and/or maintain the premises and/or warn Plaintiff of the dangerous condition was a proximate cause of Plaintiff's injuries," states the petition.
The lawsuit claims that these businesses failed in their responsibilities as property owners by not ensuring safe conditions for invitees like Castro. It further alleges negligent hiring practices and inadequate training for employees responsible for maintaining safety standards at the establishment. The plaintiff argues that such negligence constitutes gross misconduct with complete disregard for public safety.
In terms of relief sought from this legal action, Shirley Castro is pursuing monetary compensation exceeding $250,000 but not more than $1 million. This includes recovery for medical expenses incurred due to her injuries as well as compensation for physical pain and mental anguish experienced since the accident. Additionally, she seeks exemplary or punitive damages due to what she describes as reckless indifference by the defendants towards her safety.
