In a dramatic turn of events, a resident of Harris County has filed a lawsuit against several businesses for negligence after suffering serious injuries due to unsafe conditions at a local restaurant. On May 8, 2025, Carla Wishom lodged her complaint in the District Court of Harris County, Texas, targeting BB’s Cafe Services, LP, BOZ Partners, LLC, and BB’s Tex-Orleans Hospitality Management GP, LLC. The plaintiff alleges that these entities failed to maintain safe premises at their restaurant location.
The incident in question occurred on June 14, 2023, when Carla Wishom visited the BB’s Tex-Orleans Restaurant located at 515 Westheimer Road in Houston. As she made her way towards the restroom facilities within the establishment, she slipped on water that had accumulated on the floor from a leaking air conditioning unit. The fall resulted in severe injuries to her neck and shoulder, including nerve damage. According to Wishom's petition, "the ceiling tiles appeared to be failing," suggesting that the air conditioning unit had been neglected for some time. Furthermore, there were no warning signs indicating the hazardous condition.
Wishom contends that the defendants' failure to repair the defective air conditioning unit and properly maintain the flooring created a dangerous environment that led directly to her injuries. She accuses them of breaching their duty by not warning patrons about the perilous condition or taking steps to rectify it. The plaintiff argues that this breach was "the proximate cause" of her injuries and seeks justice through legal action.
In terms of relief sought from the court, Carla Wishom is demanding compensation for various damages incurred as a result of her fall. These include past and future medical expenses related to necessary care and treatment for her injuries; physical pain and suffering endured both previously and anticipated in the future; physical impairment; disfigurement; loss of earning capacity; and loss of household services. Her petition specifies monetary relief exceeding $1 million but less than $10 million.
Representing Carla Wishom are attorneys Scott Lidji and Mary Jo R. Betzen from The Lidji Firm based in Dallas, Texas. They have called upon the court to award their client all appropriate damages within its jurisdictional limits while emphasizing adherence to Rule 47 of Texas Rules regarding civil procedure claims amounting over $1 million but under $10 million.
This case has been assigned Case ID No. 100615048 with Judge Marilyn Burgess presiding over proceedings at Harris County's District Court No.55.
