Plaintiff Alleges Negligence Against Medical Professionals at Texas Children's Hospital Following Son's Death

Mendy Weiman has filed a lawsuit against Texas Children's Hospital and several associated medical professionals, alleging negligence in the treatment of her deceased son, Matthew Weiman. The complaint was lodged on October 6, 2024, in the District Court of Harris County, Texas. The defendants named in the case include Texas Children's Hospital, Dr. Athar Qureshi, Dr. Benjamin Yu, Dr. Susan Laurie Jarosz, and Baylor College of Medicine.

The lawsuit stems from events that transpired between October 25 and November 4, 2022. According to the filing, Matthew Weiman was admitted to Texas Children's Hospital for an elective cardiac catheterization procedure performed by Dr. Athar Qureshi. During this procedure, complications arose when a Foley catheter was improperly placed by Nurse T. Boutte under Dr. Qureshi's supervision, resulting in trauma and hematuria (blood in urine). Despite these complications and signs of infection indicated by rising white blood cell counts, no antibiotics were prescribed upon Matthew's discharge on October 26.

Tragically, Matthew returned to the hospital on November 3 with discomfort related to the catheter and died the following day due to Staphylococcus aureus sepsis with multiorgan systemic infection. The plaintiff alleges that this outcome was preventable had proper medical protocols been followed—specifically citing failures in prescribing prophylactic antibiotics and ordering necessary urine cultures post-procedure.

The lawsuit accuses all involved parties of negligence: Dr. Qureshi for failing to manage post-operative care properly; Drs. Yu and Jarosz for not adhering to standard care practices regarding antibiotic use; Baylor College of Medicine for inadequate training; and Texas Children’s Hospital for its staff's negligent actions during catheter placement. These alleged failures are claimed to have directly led to Matthew's untimely death.

Mendy Weiman seeks over $1 million in damages for wrongful death and survival claims under Chapter 71 of the Texas Civil Practices and Remedies Code. She is pursuing both compensatory damages for physical pain and suffering endured by her son before his death as well as punitive damages due to what she describes as grossly negligent conduct by the defendants.
