Plaintiff alleges negligence against hospital companies over unsafe conditions

In a gripping legal battle that has emerged from Harris County, Texas, an individual has taken on a formidable trio of corporate entities over alleged negligence that resulted in severe personal injuries. Armando Reyes Ayala filed a complaint against Tomball Texas Hospital Company, LLC, HMA-TRI Holdings, LLC, and Letsos Company on October 18, 2024. The lawsuit was lodged in the District Court of Harris County under case number 2024-72564.

The case revolves around an incident that occurred on April 24, 2023, when Ayala visited HCA Houston Tomball to perform work duties. During his visit, Ayala encountered a perilous situation allegedly caused by leaking fluid from machines serviced by Letsos Company. As he exited the premises after completing his work, Ayala slipped and fell due to the fluid leak, sustaining significant injuries. According to the petition filed by Ayala's attorney Joshua R. Leal of Kwok Daniel Ltd., L.L.P., this accident was preventable and stemmed from the defendants' failure to maintain safe premises.

Ayala accuses Tomball Texas Hospital Company and its parent company HMA-TRI Holdings of negligence for not ensuring their property was free from hazards like the leaking fluid. The plaintiff claims these companies failed in their duty to warn him about potential dangers or make necessary repairs to avoid such incidents. Furthermore, Ayala asserts that Letsos Company is equally culpable for not adequately servicing or managing the machinery that led to his fall.

The legal document details several allegations against the defendants including premises liability and negligent hiring practices. It states that "Defendants TOMBALL, HMA and/or LETSOS knew or reasonably should have known of the danger" posed by the leaking fluid but did not take appropriate actions to mitigate risks or inform invitees like Ayala about these dangers. Additionally, it highlights failures in training employees and enforcing safety protocols as contributing factors to the incident.

Ayala seeks monetary relief exceeding $250,000 but not more than $1 million for medical expenses, pain and suffering, mental anguish, disfigurement, physical impairment as well as exemplary damages due to gross negligence exhibited by all three defendants. The plaintiff argues that these damages are justified given what he describes as "careless," "negligent," and "reckless disregard" for his safety shown by Tomball Texas Hospital Company LLC., HMA-TRI Holdings LLC., and Letsos Company.
