Jessica Romero has filed a lawsuit against Kroger Texas, LP, alleging negligence after a slip-and-fall incident at one of their stores. The complaint was filed on October 23, 2024, in the District Court of Harris County, Texas. Romero is seeking damages between $250,000 and $1 million.
According to the petition, Jessica Romero was shopping at a Kroger store located on Memorial Drive in Houston on August 26, 2023. While in the store, she slipped on an unmarked liquid spill and sustained serious injuries. Romero claims that Kroger's employees were negligent in maintaining safe premises for customers by failing to detect and address the hazardous condition promptly. "Kroger had a duty to provide her with a reasonably safe shopping premises," states the complaint. The lawsuit accuses Kroger of premises liability and common law active negligence, arguing that the company failed to adhere to established safety policies and procedures.
Romero asserts that Kroger's managers and employees either created or neglected to notice the dangerous condition despite it existing long enough for them to have done so. The lawsuit details how Kroger allegedly breached its duty by not marking or cleaning up the spill and failing to warn customers like Romero about such hazards. "It was or should have been foreseeable to Kroger...that injuries such as those sustained by Plaintiff Mrs. Romero...would occur," reads part of the complaint.
The plaintiff seeks compensation for various damages including physical pain and suffering, mental anguish, loss of enjoyment of life, physical impairment, disfigurement, medical expenses both past and future, as well as lost household services. Additionally, she requests pre-judgment interest at the highest legal rate allowed by Texas law along with post-judgment interest until any awarded judgment is fully paid.
