Plaintiff Alleges Negligence Against Retail Giant Marmaxx Operating Corp Over Store Injury

In a recent legal filing, a Texas resident has taken action against a well-known retail corporation and an unidentified individual, alleging negligence that resulted in significant personal injury. On October 25, 2024, Petra Castrejon filed a complaint in the District Court of Harris County, Texas, targeting Marmaxx Operating Corp., which operates under the trade name Marshalls, along with an unnamed defendant referred to as John Doe.

The case stems from an incident on June 12, 2024, when Castrejon was shopping at a Marshalls store located at 20420 US-59 in Humble, Texas. While navigating the hair product aisle, she slipped on what is described as a "translucent wet substance" on the floor. Castrejon claims she was unaware of the hazard prior to her fall. The plaintiff alleges that this dangerous condition was left by either the unknown John Doe or employees of Marshalls and that the store failed to provide adequate warnings or barriers to prevent such accidents.

According to the petition, Defendant Marshalls had substantial business operations within Texas and thus falls under the jurisdiction of Texas law. The lawsuit accuses Marshalls of failing to maintain safe premises for its customers and neglecting its duty of care by not addressing or warning about hazardous conditions in their store. Additionally, it claims gross negligence on behalf of both defendants for consciously disregarding safety protocols that could have prevented Castrejon's injuries.

Castrejon is seeking damages exceeding $1 million for her injuries which include a broken wrist among other physical impairments. She demands compensation for past and future medical expenses, lost wages, pain and suffering, mental anguish, impairment, disfigurement, court costs, and punitive damages. Furthermore, she requests exemplary damages under Texas Civil Practices and Remedies Code due to what she describes as extreme risk posed by the defendants' actions.
