Elizabeth Razminas has filed a lawsuit against a prominent Texas hospital and several of its staff members, alleging severe violations of her rights during an emergency room visit. The complaint was filed by Razminas in the District Court of Harris County, Texas, on October 24, 2024, targeting The Methodist Hospital, doing business as Houston Methodist Hospital Emergency Care Center at Voss, along with Dr. Yen-Te Christian Tu and nurses William Hamlyn and George Florida.
The case stems from an incident on August 14, 2022, when Razminas visited the hospital's emergency care center seeking medical attention for hip and lumbar spine pain. According to the complaint, the hospital staff failed to provide the necessary medical screening examination required under both state law and the federal Emergency Medical Treatment and Labor Act (EMTALA). Instead of receiving proper care, Razminas alleges she was subjected to discriminatory treatment due to her disabilities, in violation of the Americans With Disabilities Act (ADA).
Razminas recounts a particularly distressing encounter with nurse William Hamlyn who allegedly shouted at her in front of other patients, "We do not take cases like you here!" This incident is cited as a breach of patient confidentiality laws under HIPAA. Furthermore, she claims that her medical records were falsified to cover up these incidents and that video evidence from her visit was destroyed.
The plaintiff asserts that these actions not only breached legal standards but also inflicted emotional distress. She accuses Dr. Tu of complicity if he indeed consulted or advised other staff regarding her treatment. The lawsuit highlights numerous alleged inaccuracies in Razminas' emergency room records and accuses the defendants of defamation.
Razminas seeks compensatory damages for physical pain, mental anguish, medical expenses incurred thus far, and future medical costs. Additionally, she demands punitive damages due to what she describes as willful misconduct by the hospital staff. She insists that these acts were ratified by The Methodist Hospital itself since no disciplinary action was taken against any involved personnel.
