Motorist Accuses Fellow Driver Aries Ramses Sibaja of Negligence Leading to Severe Injury

A recent court filing has brought to light a serious accusation involving a motor vehicle accident that left one individual severely injured. On December 11, 2024, Jivan Tameshwar Persad filed a complaint in the District Court of Harris County against Aries Ramses Sibaja, alleging negligence that resulted in a car crash.

According to the details laid out in the petition, Persad claims that on December 7, 2023, while traveling southbound on Woodham Drive in Harris County, Texas, his vehicle was struck by Sibaja's car. The collision occurred when Sibaja allegedly failed to yield the right of way while traveling westbound on Lockhaven Drive. This failure to adhere to traffic laws and standards is said to have caused significant injuries to Persad. The plaintiff asserts that Sibaja's actions were not only negligent but also reckless and careless, failing to maintain proper lookout and control of his vehicle. "Defendant Aries Ramses Sibaja disregarded the stop sign," states the petition, emphasizing the alleged breach of duty of care expected from any reasonable driver under similar circumstances.

The legal document further outlines several specific acts of negligence attributed to Sibaja. These include failing to be attentive to surroundings, driving with willful disregard for safety (in violation of Texas Transportation Code § 545.401), not controlling speed appropriately, neglecting timely brake application, and driving recklessly without taking evasive action to prevent the collision. As a result of these alleged failures, Persad sustained injuries that required medical attention and incurred various damages.

Persad seeks judgment against Sibaja for an amount exceeding $250,000 but less than $1 million. The relief sought includes compensation for past and future medical expenses, physical pain and suffering, physical impairment both past and future, lost wages and earning capacity, disfigurement and scarring as well as mental anguish experienced due to the incident. Furthermore, Persad is pursuing exemplary or punitive damages on grounds of gross negligence by Sibaja—asserting that he acted with conscious disregard for the safety of others despite knowing the risks involved.
