A serious lawsuit has been filed in Harris County, Texas, where a plaintiff is seeking over $10 million in damages from a healthcare facility and its parent company following a severe injury incident. Devonte Osbey filed the complaint on December 13, 2024, against Houston PPH, LLC, doing business as HCA Houston Healthcare Medical Center, and HCA Healthcare Inc.

The case stems from an incident that occurred on December 14, 2022. According to the petition filed by Osbey, he was at the HCA Houston Healthcare Medical Center for employment purposes when he suffered significant injuries due to falling fixtures from the ceiling. The lawsuit claims that these fixtures struck Osbey, causing him to fall and lose consciousness. As a result of this accident, Osbey sustained severe personal injuries. The complaint accuses the defendants of negligence for failing to maintain safe premises and not warning about potential hazards. "Defendants owed a duty of reasonable care," states the petition, highlighting failures such as not inspecting for hazards or providing adequate safety measures.

Osbey's legal action includes claims of negligence and premises liability against the defendants. He argues that they failed in their responsibility to ensure the safety of invitees like himself by not maintaining safe conditions or adequately warning about dangers on their property. Additionally, Osbey invokes the doctrine of respondeat superior, holding the defendants accountable for their employees' actions related to maintaining safe premises.

In terms of relief sought from the court, Osbey is demanding compensation for various damages resulting from his injuries. These include past and future medical expenses, physical pain and suffering, mental anguish, physical impairment, loss of earnings capacity, and disfigurement. The plaintiff also requests a jury trial to resolve these issues.
