Pedestrian Sues Driver Over Negligence After Electric Scooter Collision

A shocking incident has led to a legal battle in Harris County, Texas, where a pedestrian was struck by a vehicle while operating an electric scooter. The plaintiff, Chang Seok Lee, filed a complaint against Doris K. Nurowska on December 13, 2024, alleging negligence and seeking over $1 million in damages.

The lawsuit was filed in the District Court of Harris County, Texas. According to the petition, the incident occurred on November 28, 2023, at the intersection of 3900 Loop W. and 9500 Stella Link in Harris County. Lee claims that Nurowska's sudden and violent maneuvering of her vehicle resulted in him being struck while he was lawfully using an electric scooter on the sidewalk. The complaint outlines that Lee sustained significant personal injuries due to this collision.

Lee accuses Nurowska of multiple acts of negligence including failing to pay attention to driving conditions, failing to control her speed, not yielding to pedestrians, and neglecting to apply brakes properly. These actions are said to have directly caused Lee's injuries. Furthermore, Lee alleges gross negligence on Nurowska's part for her reckless disregard for his safety which involved an extreme degree of risk given the circumstances.

The plaintiff also claims that Nurowska violated local ordinances and state traffic laws constituting negligence per se. Specifically mentioned are violations under the Texas Transportation Code for driving with reckless disregard for safety and failing to maintain an assured clear distance from others on the road.

In terms of relief sought from the court, Lee is requesting compensation for medical expenses incurred due to his injuries as well as damages for physical pain and suffering, mental anguish, lost wages, and loss of earning capacity both past and future. Additionally, he seeks exemplary damages due to what he describes as Nurowska’s conscious indifference towards his rights and safety.
