NIRP Sugar Land, PLLC has filed a lawsuit against a former employee, alleging breach of contract and fiduciary duty violations. The complaint was lodged in the District Court of Harris County, Texas, on December 20, 2024, targeting Jason Hwang, DO.

The plaintiff, NIRP Sugar Land, PLLC doing business as Pad Specialists — Sugar Land PLLC (PADS), claims that Jason Hwang violated the terms of his employment agreement. According to the petition, Hwang had entered into a Physician Employment Agreement with PADS on or about September 2, 2022. However, he allegedly breached this contract by retaining confidential information after resigning from his position effective September 23, 2024. The lawsuit contends that Hwang's actions have resulted in financial harm to PADS due to the misuse of sensitive data including contacts and information about referring physicians and nurse practitioners.

The petition further accuses Hwang of breaching his fiduciary duty by refusing to return or destroy confidential information belonging to PADS. It asserts that Hwang’s retention and potential use of this information for personal gain violates the fiduciary responsibilities he owed to his former employer. The plaintiff argues that these breaches have directly caused injury to their business operations and revenue.

In response to these alleged infractions, NIRP Sugar Land is seeking various forms of relief from the court. They are asking for actual damages along with pre-judgment and post-judgment interest. Additionally, they seek reimbursement for court costs and attorney fees as stipulated in their employment agreement with Hwang. The plaintiff has also requested a jury trial to resolve these disputes.

Representing NIRP Sugar Land is attorney Pete T. Patterson from Patterson PC law firm based in Houston, Texas. The case is filed under Case ID 2024-88459 in the District Court of Harris County with Judge Tayler Hatcher presiding over the proceedings.
