A devastating workplace accident has led to a significant legal battle, as an employee seeks justice for injuries sustained due to alleged negligence and defective equipment. Jesus Tereso Ramirez filed a complaint on December 18, 2024, in the District Court of Harris County, Texas, against Mustang Machinery Company, Ltd., KTS Investments, L.L.C., and All Imports Auto Parts. The case centers around an incident that occurred on October 24, 2024, at a wrecking yard operated by KTS Investments and All Imports Auto Parts.
The lawsuit filed by Jesus Tereso Ramirez alleges that while working at the premises located at 1500 Carson Street in Fort Worth, Texas, he was severely injured when struck by a loader machine operated by another employee. This machine allegedly lacked essential safety features such as reverse alarms and emergency stop systems. Ramirez claims that these deficiencies contributed to his injuries when he was pinned against a wrecked vehicle. According to the petition, "Plaintiff had to drag himself out of the vehicle he was pushed into and could not walk," highlighting the severity of his condition.
Ramirez accuses Mustang Machinery Company of manufacturing and distributing the defective loader machine used during the incident. He asserts that the machine's design was inherently flawed due to its lack of warning systems capable of alerting operators or nearby individuals about potential dangers. Furthermore, Ramirez contends that KTS Investments and All Imports Auto Parts failed in their duty to provide a safe working environment by neglecting necessary training and safety protocols for their employees.
The plaintiff is seeking monetary relief exceeding $1 million for damages including medical expenses, physical pain and suffering, mental anguish, lost wages, and loss of earning capacity. Additionally, Ramirez is pursuing exemplary damages against the defendants for gross negligence under Texas Civil Practices and Remedies Code § 41.001.
Represented by attorneys Ryan T. Wagner and Hannah L. Bowers from Armstrong Lee & Baker LLP in Houston, Texas, Ramirez demands a jury trial to address his grievances fully. The case has been assigned Case ID 2024-87898 with Judge Monica Jackson presiding over proceedings in Court 281.
