In a gripping legal battle, a Houston resident has taken on a major corporation over an alleged slip-and-fall incident that resulted in severe injuries. Luis Lizardo filed a complaint against 7 Eleven, Inc. in the District Court of Harris County, Texas, on December 19, 2024. The lawsuit accuses the convenience store giant of negligence and premises liability following an accident that occurred in May 2023.
According to the complaint, Luis Lizardo entered a 7 Eleven store on May 6, 2023, intending to purchase food and other items when he slipped on spilled coffee that had not been cleaned up or marked with warning signs. This incident allegedly led to significant injuries requiring medical attention. Lizardo claims that 7 Eleven failed in its duty to maintain safe premises for customers and neglected to warn them of potential hazards. "Defendant breached this duty by not only allowing customers within its store but also by failing to warn its customers of the unreasonably dangerous condition," states the petition.
The plaintiff argues that 7 Eleven's negligence is evident through various acts of omission and commission, including creating hazardous conditions and failing to exercise ordinary care in maintaining safe premises. Lizardo's legal team asserts that these failures directly caused his injuries and subsequent damages. The lawsuit highlights multiple allegations against the defendant, such as negligent training and supervision of employees who should have been responsible for identifying and rectifying dangerous conditions.
Lizardo seeks monetary relief exceeding $1 million from 7 Eleven for his physical injuries, emotional distress, medical expenses, loss of earnings capacity, and other related damages. He demands compensation for past and future pain and suffering as well as mental anguish resulting from the incident. The plaintiff also requests pre-judgment interest, post-judgment interest, court costs, and any additional relief deemed appropriate by the court.
Representing Luis Lizardo are attorneys Nefi K. Lopez (Texas Bar No. 24106219), Pablo Franco (Texas Bar No. 24121625), and Russell Morris (Texas Bar No. 24099150) from Lopez Franco PLLC based in Houston, Texas. The case is presided over by Judge Nelson Cuero under Case ID: 2024-88077 in the District Court of Harris County.
