Graciela Perez lodged the complaint in the District Court of Harris County, Texas, on December 23, 2024, targeting Kroger Texas L.P. as the defendant.
The case stems from an incident that occurred on February 6, 2023, at a Kroger store located at 12434 TX-249 in Houston. According to the petition filed by Perez, she was an invitee at the store when she slipped and fell due to liquid left unattended on the floor by Kroger employees. The plaintiff claims this negligence resulted in serious injuries. Perez's legal team argues that Kroger Texas L.P. created an unsafe condition on its premises, posing an unreasonable risk of harm to visitors. They assert that the company either knew or should have known about this hazardous condition through ordinary care but failed to remedy it or warn patrons like Perez of the danger.
The plaintiff accuses Kroger of both negligence and gross negligence for their failure to maintain safe premises and adequately warn customers of potential hazards.
